0.- PREAMBLE
University of Alicante's Governing Board approved the March 17, 2000 a “ Code of ethics for use of the computer network ”. The elapsed time, technological changes, increasing the number of services, the widespread use of these services throughout the university community and the emergence of new legislation regarding this matter requires update these regulations.
1.- OBJECTIVE AND SCOPE
The University of Alicante wants to promote the use of new information technologies, without undermining individual rights and freedoms enshrined in our legal system and ensuring the best use of their According to the latest in the Finnish university: research, teaching and study.
The purpose of this legislation is to ensure the quality of service and regular communications and the use thereof.
Its scope extends to all members of the university community, as well as all those who make use of the Information Systems and Communications at the University of Alicante or the services provided by them. Anyone who connects to the network is subject to the terms and conditions contained in this document.
Without prejudice to the provisions of these rules will be rules tambiéna other regulatory services such as e-mail, wireless networks, computer rooms open and new ones that may arise and which may be related to the subject of this.
These terms and conditions are supplementary to laws at the national or community which may be applicable.
2.- USE OF RESOURCES
Computing resources and communications at the University of Alicante will be used for tasks related to the purpose of it and for administrative services to be provided for compliance.
2.1.- User responsibility
It is the responsibility of the user to use the services.
Must maintain confidentiality of passwords that provide access to various resources.
2.2.- Misuse of resources
Are considered misuse of the following:
2.2.1.- On the purpose and nature of use
a) The use of resources for private, personal, recreational or other not strictly related to the activities of the AU, except with permission.
b) The use for commercial purposes unrelated to the activities of the AU and not properly authorized.
c) Transmit any illegal content, particularly to disseminate content that is racist, xenophobic, pornographic, sexist, apology of terrorism, dangerous, threatening, defamatory, obscene, attenting human rights or act prejudice any right to privacy, honor, self-image or the dignity of persons and the protection of personal data.
d) The distribution and use of material that violates intellectual property rights.
e) In general, the transmission of information act that violates the law.
2.2.2.- About confidentiality and identity theft.
a) Access to computers, applications, data and information networks to which they are duly authorized. They must not allow others to do so.
b) Perform actions to obtain the passwords of other users without their consent.
c) Share resources (files, directories, etc..) Without the necessary security mechanisms available in each operating system and/or applications to ensure the safety of your computer and the network.
d) Destruction, misappropriation of handling the information flowing through the network or belongs to other users.
2.2.3.- On the integrity and availability of resources
a) The attempt to cause any physical or logical computing resources of the AU: equipment, applications, software, documentation, etc.
b) The development or use of programs that can cause outages or non-availability servers, network equipment or any other resources (denial of service attacks).
c) The development, use or distribution of programs with the objective intent is to harm other systems or access to restricted resources (malware, viruses, trojans, backdoors, etc..) Or may be harmful to the proper functioning of computer systems ; tion of the AU.
d) The unauthorized modification of permissions or privileges on computer systems.
e) Installing software without a license on the computers of the AU.
2.2.4.- On the use of infrastructure
a) The connection of active network equipment (hubs, switches, routers) to disrupt the proper functioning of the network of the UA or compromise the security, unless explicit authorization by the competent authority in this matter.
b) Provide external access from the communications network through the installation of remote access, unless explicit authorization by the competent authority in this matter.
c) Accommodation of different domains to ua.es, unless explicit authorization of the competent body in this area.
d) The installation of telematics servers or other (web, mail, etc.). Without adequate safety measures.
e) The connection, disconnection relocation of equipment from outside, without the express permission of those responsible.
f) Providing access to network resources to unauthorized persons.
g) Do not use a rational, efficient and considerate of the resources available, such as disk space, memory, telephone lines, terminals, communication channels, etc..
3.- Conditions of service
3.1.- Limitations of use.
The AU, through the body with responsibility for ICT may establish limitations on the use of services, in order to maintain operability and availability of services, without prejudice to ensure authentication , confidentiality and integrity of information and communications.
Also, when misuse is detected or not acceptable by any user may decide to disconnect from the network resource or affected block access to certain services.
3.2.- Retention of information on traffic and use of services.
For reasons of security and functionality of the computer and communications services offered by the AU and in order to ensure its proper use, and comply with the law, the conduct of Informatics a regular basis monitoring the use of these services and resources, respecting, in any case, the right to privacy and confidentiality of communications. This monitoring includes generacióny log file, the monitoring of communications and other techniques which can identify and prevent problems in the operation.
It also can be applied whatever techniques are deemed necessary to ensure operation within the normal (deteccióny programs for virus removal, software anti-spam filter ,...).
The AU, through the body that has assumed the powers in these matters, and the report of the Legal Department, may carry specific tracking of your access to users in very justified to make necessary an act of interference necessary for the proper and orderly conduct of its business, for the clarification of labor offenses, criminal, or, if otherwise.
3.3.- Privacy Commitment.
All personnel associated with the AU, whatever type of contract and including those belonging to outside companies with which it has established a contractual relationship, takes “ an implicit commitment of confidentiality by which ” must fulfill the obligation of secrecy and confidentiality with regard to files and content to have access for their work.
The confidentiality of passwords and content to which this paragraph does not exclude the possibility that, in strict compliance with the relevant legal requirements or, where appropriate, authority legally authorized to be disclosed the contents and the identity of the authors.
3.4.- Exemption from liability for the operation and use of services
You agree that the AU has no responsibility or legal obligation by the removal failed to save messages or other communications or other Content maintained or transmitted by the services.
The AU is exempted from any liability for any damages that may arise from the access to and eventual manipulation of the data managed by these services.
The AU is exempted from any liability arising from the malfunction of the services that have its origin in an accidental circumstances, force majeure, required maintenance work or any other cause not imputable to it.
4.- PENALTIES
Breaches of these terms of use, as well as those set out in the rules of other services, as mentioned earlier, may lead to the initiation of legal action, disciplinary or any other nature, which may be applicable, notwithstanding the suspension of service and/or the temporary blockage of the systems that might be taken as preventive measures.
The University of Alicante will knowledge of the judicial authority and the Security Forces of the State that those violations may constitute a crime.
5.- ENTRY INTO FORCE
This standard shall become effective upon the day following its publication in the BOUA.
